Terms & Conditions – SMAK’s Hotel & Restobar and SYKE Travel & Tours

By accessing this website, making a booking, staying at SMAK’s Hotel, ordering from SMAK’s Restobar, purchasing from our online shop, or booking travel services through SYKE Travel & Tours, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. These Terms are governed by the applicable laws of the Republic of the Philippines. Last updated: April 16, 2026.

2. Booking & Contract Formation

All bookings made through this website, email, social media, partner platforms, or any other communication channel are subject to availability and final confirmation.

A binding booking is only formed once the required payment, whether full or partial, has been successfully received and a booking confirmation, voucher, or written confirmation has been issued.

We reserve the right to refuse, decline, or cancel any booking in cases including but not limited to force majeure, pricing or system errors, supplier limitations, operational constraints, or regulatory restrictions.

3. Hotel House Rules

Check-in: 2:00 PM
Check-out: 11:00 AM

Early check-in and late check-out are subject to availability and may be subject to additional charges.

Guests are personally liable for all costs and charges incurred during their stay, regardless of the payment method used.

If any costs or charges remain unpaid, the guest acknowledges full responsibility and liability for such outstanding amounts.

4. Valuables & Personal Belongings

Money, jewelry, documents, gadgets, and other valuables brought onto the property are at the guest’s sole risk.

SMAK’s Hotel, its management, owners, staff, and affiliates accept no liability for loss, theft, or damage to personal belongings, unless liability cannot be excluded under applicable law.

Guests are solely responsible for the safekeeping of their valuables and personal belongings.

5. Personal Information Usage

Guests and users consent to the use of their personal information for administrative, booking, operational, customer service, and marketing purposes.

We do not sell personal information to third parties. Personal information may only be shared where necessary with affiliated companies, payment providers, booking platforms, service providers, government authorities, or where required by law.

6. SYKE Travel & Tours – Agency Role & Third-Party Services

SYKE Travel & Tours acts as an intermediary, coordinator, and booking agent for transportation services, tours, accommodations, and flights that may be provided by independent third-party operators or suppliers.

SYKE Travel & Tours does not own, operate, manage, or control vehicles, vessels, aircraft, hotels, or other service infrastructure used in the delivery of third-party services, unless expressly stated otherwise.

Payments received by SYKE Travel & Tours may include the cost of the third-party service and a service fee, coordination fee, or commission retained by SYKE Travel & Tours.

7. Payment Policy

Payments may be made through approved payment methods, including cash, bank transfer, e-wallets, remittance centers, credit or debit card payments, or approved online payment links.

Reservations remain tentative until the required prepayment has been successfully received and acknowledged.

Unless otherwise stated, the minimum prepayment is 50% of the total booking value.

The final balance for multi-day tours, packages, or accommodation bookings is due no later than 7 days before arrival or departure, unless a different deadline has been agreed in writing.

For multi-destination, seasonal, or dynamically priced packages, final pricing may vary by up to 10% due to supplier adjustments, fuel surcharges, route changes, or similar operational factors.

8. Cancellation & Refund Policy

Day Tours & Transfers:
Full refund if cancelled at least 48 hours before departure.

Hotels & Accommodations:
Cancellations made at least 48 hours before arrival may be eligible for up to a maximum 50% refund. Reservation fees, administrative fees, and non-recoverable supplier charges are non-refundable.

Multi-Day Tours:

  • 70% refund if cancelled 60 days or more before departure
  • 50% refund if cancelled 14–59 days before departure
  • 0% refund if cancelled 0–13 days before departure

Flights between Cebu and Bantayan Island are strictly non-refundable, unless otherwise required by applicable law.

Refunds are subject to applicable transaction fees, payment gateway charges, remittance costs, foreign exchange losses, administrative costs, and other non-recoverable processing fees.

9. Weather, Safety, Delays & Force Majeure

Travel services may be affected by weather, sea conditions, safety concerns, natural disasters, port closures, government actions, transport disruptions, strikes, fuel shortages, supplier cancellations, or other events beyond our reasonable control.

In such cases, refunds, credits, rebooking options, or alternatives shall be determined fairly in accordance with applicable law, supplier policies, and the recoverability of amounts already paid to third-party providers.

10. Online Shop – Refunds & Returns

Our refund and returns policy for physical products lasts 30 days. If 30 days have passed since your purchase, we cannot offer a full refund or exchange.

To be eligible for a return, your item must be unused, in the same condition that you received it, and in the original packaging.

Non-returnable items include perishable goods, food items, gift cards, downloadable products, personal care items, intimate or sanitary goods, hazardous materials, flammable liquids or gases, and sale items.

To complete your return, we require a receipt or proof of purchase.

Once your return is received and inspected, we will notify you by email about the approval or rejection of your refund.

Approved refunds will be processed to the original payment method within a reasonable processing period, subject to bank or payment provider timelines.

11. Online Shop – Exchanges & Shipping Returns

We only replace items if they are defective or damaged. If you need an exchange for the same item, please contact us first by email.

Customers are responsible for paying their own shipping costs for returning items. Shipping costs are non-refundable.

If you receive a refund, the cost of return shipping may be deducted from your refund where applicable.

For higher-value items, we recommend using a trackable shipping service or purchasing shipping insurance. We do not guarantee that returned items will be received.

12. Website Use & Third-Party Links

This website may contain links to third-party websites, platforms, services, or content that are not owned or controlled by us.

We assume no responsibility for the content, privacy policies, terms, practices, or reliability of any third-party websites or services.

Users are advised to read the terms and privacy policies of any third-party websites or services they visit.

13. User Content, Reviews & Comments

Where permitted, users may submit comments, reviews, feedback, images, or other content through the website or affiliated platforms.

By submitting such content, you grant SMAK’s Hotel & Restobar and SYKE Travel & Tours a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, display, and distribute such content for lawful business and promotional purposes.

We reserve the right to remove or decline any content deemed unlawful, defamatory, offensive, misleading, abusive, infringing, fraudulent, or otherwise inappropriate.

14. Intellectual Property

All content on this website, including text, images, graphics, logos, branding elements, videos, downloadable materials, and other media, is the intellectual property of SMAK’s Hotel & Restobar, SYKE Travel & Tours, or their respective licensors.

15. Limitation of Liability

To the fullest extent permitted by applicable law, SMAK’s Hotel & Restobar and SYKE Travel & Tours shall not be liable for direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising from:

  • acts, omissions, negligence, delays, cancellations, or service failures of third-party operators or suppliers;
  • accidents, injuries, loss, theft, or damage to persons or property;
  • force majeure events, weather disruptions, transport delays, port closures, or government restrictions;
  • temporary unavailability, errors, or interruptions of the website, booking systems, payment platforms, or communication channels.

Where liability cannot be excluded under applicable law, liability shall be limited to the amount actually paid by the client for the specific service giving rise to the claim.

16. “As Is” and “As Available” Disclaimer

The website and online services are provided on an “as is” and “as available” basis. We do not guarantee that the website will be uninterrupted, error-free, secure, or free from viruses or harmful components.

We make reasonable efforts to keep information accurate and updated, but we do not guarantee the completeness, reliability, or accuracy of all information displayed, especially where third-party schedules, prices, or availability are involved.

17. Consumer Protection & Fair Dealing

We aim to conduct business fairly, transparently, and in good faith, and comply with applicable consumer protection requirements of the Republic of the Philippines, including the Consumer Act of the Philippines, where applicable.

Complaints or disputes shall be addressed in good faith, with the objective of reaching an amicable resolution whenever reasonably possible.

18. Termination of Website Access

We may terminate or suspend access to the website or services immediately, without prior notice or liability, if a user breaches these Terms or engages in unlawful, abusive, fraudulent, or harmful conduct.

19. Severability, Waiver & Translation

If any provision of these Terms is held to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.

Failure to enforce any right or provision shall not constitute a waiver of such right or provision.

If these Terms are translated into another language, the English version shall prevail in case of dispute or inconsistency.

20. Governing Law & Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of the Philippines.

Any dispute, claim, or controversy arising out of or in connection with these Terms, bookings, purchases, or services shall first be resolved informally by contacting us.

If no amicable resolution is reached, disputes shall be submitted to the competent courts of Cebu, Philippines, unless otherwise required by mandatory law.

21. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. Any updated version will be posted on this website.

By continuing to access or use the website, make bookings, purchase products, or use our services after updates become effective, you agree to be bound by the revised Terms.
